Terms And Conditions of BISMA IT SERVICES

The full terms and conditions governing your subscription to website design, development, and other internet-related services offered by BISMA IT SERVICES (the "Services") are set forth in this Services Agreement (the "Agreement"). BISMA IT SERVICES is referred to as "BISMA IT SERVICES" and “Client”, “you”, or “You’re” refer to the Client as used in this Agreement. You declare that you have read the Agreement and that you accept all of its terms as well as all other policies that have been placed on the BISMA IT SERVICES website. The terms "Site" and "BISMA IT SERVICES Site" as used in this Agreement refer to websites, and "BISMA IT SERVICES Site" refers to the website with the URL https://bismaitserv.com/ or any other successor websites that BISMA IT SERVICES owns or maintains. All website Development or Design services offered to the Client by BISMA IT SERVICES are subject to the terms and restrictions listed below.


Any Client may accept these terms and conditions without having to sign an acceptance for them to be in effect. If a client accepts a quote, the such client is understood to have understood the terms that apply and to have fully accepted these terms and conditions. Please carefully read these terms and conditions. You have read and agreed to our terms and conditions if you make a purchase or use our services.


The project quotation that the Client receives through email specifies the fees for the services that BISMA IT SERVICES is expected to render. The 30-day expiration period applies to quotations. After the 30-day period has passed, BISMA IT SERVICES maintains the right to modify or omit to offer a quotation. Unless otherwise agreed upon with the Client, the upfront payment for all website design services is at least fifty percent (50%) of the total project quotation amount before the work is delivered to the Client for inspection. Before uploading to the server or releasing the materials, the final fifty percent (50%) of the project quotation must be paid. Services must be paid for with a credit card, check, or bank transfer. Send a cheque to BISMA IT SERVICES that is made out to that company. Invoices will include bank information.


During the design phase and once the entire website development is finished, BISMA IT SERVICES will give the Client the chance to assess the website's appearance and content. Unless the client tells BISMA IT SERVICES otherwise within ten (10) days of the date the materials are made available to the client, such materials will be taken to have been accepted and approved after the project.


Unless a specific delay is specifically requested by the Client and approved by BISMA IT SERVICES, BISMA IT SERVICES will install and publicly post or supply the Client's website by the date specified in the project proposal, or at the date agreed with the Client upon BISMA IT SERVICES receiving the initial payment. In exchange, the Client consents to designate a single person as a principal contact to help BISMA IT SERVICES moves the commission along satisfactorily and quickly. BISMA IT SERVICES will need the Client to supply website material, including text, photographs, movies, and sound files, throughout the project.


Being a small firm, BISMA IT SERVICES must make sure that the job we have scheduled is completed at the appointed time to remain productive. To make sure that your work is finished at the time scheduled, there are times when we may have to turn down offers for additional work and inquiries. We, therefore, request that you provide the necessary information in advance. We retain the right to charge an additional fee if we are delayed in completing your website because we were unable to get the necessary information within the predetermined time limit. Within two weeks of the project's start, if you agree to give us the necessary information but fail to do so, we reserve the right to end the project and demand immediate payment of the outstanding balance.
NOTE: Text content should be provided as an email attachment, Microsoft Word document, or other comparable format, with the document’s pages representing the content of the appropriate website pages.


BISMA IT SERVICES will issue invoices upon completion but before releasing the live website. Normally sent by email, invoices are payable right away.


The client consents to pay BISMA IT SERVICES any additional costs incurred to complete the service. Examples include buying unique fonts, stock photos, deviating from a plan that has already been authorized, etc.


Accounts shall be deemed in default if they are not paid within thirty (30) days of the invoice date. BISMA IT SERVICES will, at its discretion, remove all such material from its web space if the Client in Default continues to store any information or files there. Any data loss resulting from the termination of the service is not the responsibility of BISMA IT SERVICES. The removal of such content does not absolve the client of his or her financial responsibility to cover any unpaid fees charged to the client's account. The client's account will be instantly deemed to be in default until full payment is received if a cheque is returned for insufficient funds. Clients whose accounts are past due consent to reimburse BISMA IT SERVICES for reasonable charges, such as attorney fees and costs associated with collection efforts by third parties, spent by BISMA IT SERVICES in upholding these Terms and Conditions.


Any request by the client to end services must be made in writing and will take effect after being received. Telephone requests to end services won't be honored unless and until they've been confirmed in writing. The client will get an invoice for the services done up until the first cancellation notice, which must be paid in full within thirty (30) days.


Only legal uses are permitted for all BISMA IT SERVICES. By using our service, you agree to keep BISMA IT SERVICES blameless from any claims made by third parties that may affect you or another party.


The Client provides BISMA IT SERVICES the right to publish and utilize any data, files, and graphic logos provided by the Client while retaining ownership of those materials. Any data or files that are protected by a third party's copyright must be used with the client's consent and within the bounds of those rights. The Client further agrees to release and keep blameless BISMA IT SERVICES from any liability arising from the Client's carelessness or failure to secure the necessary copyright licenses, as well as for granting BISMA IT SERVICES permission and rights to use the same. By signing a contract for website design and/or placement, the client is promising BISMA IT SERVICES that they have secured all necessary authorizations. It may be necessary to provide proof of authorizations and powers.


This Agreement assumes that all text will be provided by the Client in electronic format (ASCII text files delivered on the USB drive, CD, or via e-mail or FTP) unless otherwise specified in the project quotation, and that all photos and other graphics will be provided physically in high-quality print suitable for scanning or electronically in .gif, .jpeg, .png, or .tiff format. BISMA IT SERVICES shall take reasonable efforts to return to the Client any photographs or printed materials provided for use in developing the Client's website, but BISMA IT SERVICES shall have no obligation to do so.


Every effort is made by BISMA IT SERVICES to ensure that websites are made to be viewed by the majority of visitors. The most widely used modern browsers, such as Firefox, Internet Explorer, Google Chrome, etc., are supported by websites. Client acknowledges that BISMA IT SERVICES cannot guarantee proper functionality across all operating systems and browsers. Web pages that do not render properly in new browser versions published after the website has been designed and delivered to the Client are not the responsibility of BISMA IT SERVICES. As a result, BISMA IT SERVICES retains the right to provide an estimate for any work required to modify the website's design or code to make it compatible with newer browser versions.


A little visual or small type link to BISMA IT SERVICES will be shown at the bottom of the client's website. If a visual is used, it will be created to fit in with the layout of the website as a whole. The Client also agrees that the website developed for the Client may be presented in BISMA IT Service’s portfolio.


BISMA IT SERVICES must be authorized temporary read/write access to the client's storage directories, which must be reachable through FTP if the client's website is to be put on a server owned by a third party. Other resources might also need to be set up on the server, depending on the particulars of the project.


Once installed, BISMA IT SERVICES disclaims all liability for any adjustments made to the Client's pages by a third party. These changes could be additions, modifications, or removals, among other things.


All prior statements, understandings, and agreements are superseded by these Terms & Conditions. Accepting our terms and conditions by making a payment online.


BISMA IT SERVICES hereby excludes itself, its Employees, or its Agents and disclaims all liability for any of the following losses or damages:

  • Loss or damage resulting from any inaccuracy
  • Loss or damage resulting from any omission
  • Loss or damage resulting from delay or error, whether the result of negligence or another cause in the production of the website
  • Loss or damage resulting from loss or damage to clients' artwork or photos that were supplied for the website. It doesn't matter if the loss or damage is the result of negligence or something else.

The charges for the Services provided under this Agreement in respect of which the breach has occurred shall constitute the Client's complete remedy against BISMA IT SERVICES for any claim or breach of this Agreement, whether or not resulting from negligence.


The remaining provisions of this Agreement shall not be affected and the Agreement shall not be void for the sole reason that one or more of its sections are determined to be invalid, unlawful, or unenforceable. Such invalid, unlawful, or unenforceable provision shall be replaced by a valid, legal, and enforceable provision that is mutually acceptable and that most closely matches the parties' original intentions.
